Marketing Data. Marketing data includes data about your preferences in receiving and interacting with Pro Teeth Guard's advertisements or content on the Services or on third party websites or applications. We collect this data from your use of the Services and from third party advertising IDs created through advertising programs, such as Google Advertising IDs, Facebook Advertising IDs, and Microsoft Advertising IDs. Pro Teeth Guard does not connect advertising identifiers to persistent device identifiers, such as MAC addresses or mobile device IDs. Pro Teeth Guard's lawful ground for collecting and processing this marketing data is its legitimate interests in administering and offering the Services and to grow its business and marketing strategy by providing advertisements, including remarketing advertisements, to you.
Personally Sensitive Data. Personally sensitive data includes data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, union membership, or information about your health. Pro Teeth Guard does not intentionally collect personally sensitive data beyond dental health information as described below.
Biometric Data. Biometric Data is any data relating to 'Biometric identifiers,' which includes a retina or iris scan, fingerprint, voiceprint, scan of hand or face geometry, or dental impressions and dental scans. Biometric identifiers do not include writing samples, written signatures, photographs, human biological samples used for valid scientific testing or screening, demographic data, tattoo descriptions, or physical descriptions such as height, weight, hair color, or eye color. Pro Teeth Guard collects biometric data in the form of dental impressions, dental molds, bite registrations, and related dental scan data. This biometric data contains unique physical characteristics of your teeth, bite patterns, jaw alignment, and oral anatomy that can be used to uniquely identify you. We collect this biometric data solely for the purpose of creating custom dental products tailored to your specific dental anatomy. The collection of this biometric data is necessary to provide our services and manufacture custom dental products that fit your unique dental structure.
Dental Health Information. When you use our Services to order custom dental products such as teeth guards, we may collect dental health information from you, including dental impressions, information about your dental condition, bite patterns, teeth alignment, and other information related to the fabrication of your custom dental products. Pro Teeth Guard is not a HIPAA-covered entity and does not automatically collect Protected Health Information as defined by HIPAA. We collect and use dental health information solely for the purpose of creating, manufacturing, and delivering your custom dental products, improving our services, and fulfilling your orders. We do not share your dental health information with third parties except as necessary to fulfill your order (such as with shipping providers) or as required by law.
Collection and Use of Biometric Data
Notice of Biometric Data Collection: Pro Teeth Guard collects biometric identifiers in the form of dental impressions, dental molds, bite registrations, 3D dental scans, and related biometric information derived from these impressions. This biometric data includes unique physical characteristics of your dental anatomy, including but not limited to tooth geometry, bite patterns, jaw alignment, dental arch shape, palatal rugae patterns, and the spatial relationships of your teeth.
Purpose of Collection: We collect your biometric data for the following specific purposes:
To manufacture custom dental products (such as night guards, teeth guards, and other dental appliances) that are precisely fitted to your unique dental anatomy;
To ensure proper fit, comfort, and effectiveness of your custom dental products;
To maintain records necessary for warranty claims, remakes, or adjustments to your dental products;
To improve our manufacturing processes and product quality; and
To comply with legal and regulatory requirements applicable to dental laboratories.
Consent to Collection: By providing your dental impressions or dental scan data to Pro Teeth Guard, you provide your informed written consent (including electronic consent through our website) for Pro Teeth Guard to collect, store, and use your biometric data for the specific purposes disclosed above. You understand that the collection of your biometric data is necessary to provide our services, and without this biometric data, we cannot manufacture custom dental products for you.
Biometric Data Retention and Destruction: Pro Teeth Guard will retain your biometric identifiers and biometric information for the following periods:
We will retain your biometric data for the duration necessary to fulfill your order and provide customer support, typically not exceeding three (3) years from your last interaction with Pro Teeth Guard or until you request deletion of your biometric data, whichever occurs first;
We may retain your biometric data for longer periods where necessary to comply with legal obligations, resolve disputes, enforce our agreements, or as required by law; and
Upon expiration of the retention period, we will permanently destroy your biometric data using secure deletion methods that render the data unrecoverable.
You may request early destruction of your biometric data by contacting us using the information provided at the end of this Privacy Notice. Please note that early destruction of your biometric data may limit our ability to provide warranty service, remakes, or support for your custom dental products.
Biometric Data Security: Pro Teeth Guard stores, transmits, and protects your biometric identifiers and biometric information using security measures that meet or exceed the following standards:
A reasonable standard of care within the dental laboratory industry;
Security measures that are the same as or more protective than the measures we use to protect other confidential and sensitive information;
Encryption of biometric data both in transit and at rest;
Access controls that limit employee and service provider access to biometric data on a need-to-know basis; and
Regular security assessments and updates to our data protection systems.
No Sale or Profit from Biometric Data: Pro Teeth Guard does not and will not sell, lease, trade, or otherwise profit from your biometric identifiers or biometric information. We will not disclose, redisclose, or otherwise disseminate your biometric data to third parties except:
With your consent;
When necessary to complete a transaction you have requested or authorized (such as shipping your custom dental product);
When required by state or federal law or municipal ordinance; or
When required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
Pro Teeth Guard will only use your PII for the purpose for which it was collected. If Pro Teeth Guard needs to use your PII for an unrelated, new purpose, Pro Teeth Guard will provide you with notice of this new use and will explain the lawful ground for such processing. Pro Teeth Guard may process your PII without your knowledge or consent where required or permitted by law.
How do we collect this information?
We collect PII from you through a variety of different means:
Direct Collection. We may collect PII from you when you purchase products from our Website, register a User Account or for other services, contact us through the Website, via live chat, social media, or otherwise, respond to a survey, participate in a contest, submit dental impressions or dental health information, or when you opt-in to receive marketing emails, or mailings from us.
Third Party Tracking Tools. We use third party tracking tools, such as pixels, web beacons, and cookies, to automatically collect PII from you when you open, view, or click pages or links, emails, or advertisements. We disclose these third-party tracking tools below in this Privacy Notice in our disclosure of PII that we collect from third parties.
Business Partners and Service Providers. We may, from time to time, obtain PII from our business partners or service providers. When we obtain PII from our business partners and service providers, we ensure that all such business partners and service providers have obtained consent from you to transfer all such PII to us for its intended uses.

What information do we collect from third parties and how do we use it?
Pro Teeth Guard may collect data about you through cookies and other technologies. This helps Pro Teeth Guard understand how you use the Services and to understand any patterns that may be associated with your use of the Services. This aids Pro Teeth Guard in developing or improving its Services and marketing communications in response to your needs or wants.
Pro Teeth Guard may use session or persistent cookies. Session cookies are only stored on your computer or mobile device during your use of the Services and are automatically deleted when you close your web browser. How do we use your information for marketing communications?
As stated above, Pro Teeth Guard's lawful ground for sending you marketing communications is either consent or its legitimate business interests, such as to grow its business by advertising products and services to you. Pro Teeth Guard may send you marketing communications if you have asked for information concerning its goods or services or if you have agreed to, and have not opted out from, receiving marketing communications. You may ask Pro Teeth Guard to stop sending you marketing messages at any time by logging into the Services to adjust your marketing preferences within your user account or by following the opt-out link in any marketing message sent to you. If you opt out of receiving marketing communications, your opt-out does not extend to PII provided for other purposes.

When do we disclose your information?
Pro Teeth Guard may share your PII with the following parties:
Service providers that provide Pro Teeth Guard with information technology, software as a service, cloud storage, payment processing, email marketing, customer relationship management, analytics, or other administrative services;
Third-party advertising and marketing platforms such as Google Ads, Facebook, Microsoft Ads, and Klaviyo for the purpose of providing you with targeted advertising and marketing communications;
Pro Teeth Guard's accountants, auditors, insurers, or attorneys;
Law enforcement agencies upon the receipt of a subpoena or court order or where necessary to protect Pro Teeth Guard's personnel or property; and
Government bodies that require Pro Teeth Guard to report its processing activities.
Pro Teeth Guard may also transfer PII to third parties when it sells, transfers, or merges any part of its business or assets.
How do we protect your information?
We implement a variety of security measures to maintain the safety of your personal information, including when you place an order. However, no security measures are impenetrable and there are always security risks. Pro Teeth Guard will notify you and any regulatory body of any breach of your PII or Pro Teeth Guard security measures if it is legally required to do so.
Pro Teeth Guard has put into place data security measures to protect your PII. Pro Teeth Guard allows access to your PII only by employees and service providers who have a need to know or access your PII on Pro Teeth Guard's instructions.
Do we use cookies?
Yes, as stated above, we may use persistent and session cookies. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information.

For how long do we retain your data?
We will only retain your PII for so long as necessary to fulfill the purposes for which it is collected under this Privacy Notice or for the purposes of satisfying any legal, accounting, or reporting requirements. With respect to location data, technical data, usage and interaction data, and marketing data, we may retain this data for so long as it is relevant to the uses disclosed in this Privacy Notice. We may retain account data, public data, and communications data for so long as you maintain a user account with Pro Teeth Guard, and we may retain this data for longer periods where there is a need to retain this data to comply with Pro Teeth Guard's legal obligations, such as the preservation of electronic evidence or compliance with a preservation order.
Biometric Data Retention: We will retain your biometric identifiers and biometric information (dental impressions, dental scans, and related biometric data) for up to three (3) years from your last interaction with Pro Teeth Guard or until you request deletion, whichever occurs first. This retention period is necessary to fulfill your orders, provide warranty service, process remakes or adjustments, and provide customer support. After the retention period expires, we will permanently destroy your biometric data using secure deletion methods. We may retain biometric data for longer periods only where required by law or necessary to comply with legal obligations, resolve disputes, or enforce our agreements.
Right of Access, Rectification, Correction, Erasure, Transfer, and Withdrawal
Under the law, you may have a right to request access to your PII for rectification, correction, erasure, transfer, or restriction, or to object to its processing or withdraw your consent. If you wish to exercise any of these rights, please contact Pro Teeth Guard's Data Protection Officer as disclosed in this Privacy Notice.
You do not need to pay a fee to access your PII or to exercise your rights. However, Pro Teeth Guard may charge a reasonable fee if your request is unreasonable or excessive.
To confirm your request, Pro Teeth Guard may need to request specific information from you as a security measure to ensure that PII is not disclosed to an unauthorized third party. Pro Teeth Guard will attempt to respond to all legitimate requests within thirty (30) days.
California Privacy Rights
The following rules apply solely to visitors, users, and others who are residents of the State of California. California residents have the right to be notified which categories of PII are being collected and the purposes for which the PII is being used. We obtain the categories of PII marked "YES" in the above table directly from California residents when they complete forms through our Services or provide it to us as a part of a transaction or inquiry concerning our Services. We also obtain these categories of PII indirectly from California residents while observing their actions on our Services and from third parties or service providers that they have authorized to receive and share PII.
California residents have a right to request that we disclose what PII we collect from you and whether, and how, we disclose or sell that PII. California residents may also request that we delete any personal information collected or maintained by us from you.
California residents may also have the right to opt out of the sale or sharing of their personal information by contacting us or, where available, by clicking a link or icon associated with an advertisement. Specifically, this link or icon may state "Do Not Sell or Share My Personal Information." By selecting this link or icon, you "Opt Out," which means that you have opted out of the sale or sharing of your personal information as set forth in the California Consumer Privacy Act. To verify your request, we may request certain information from you to confirm that you are a Pro Teeth Guard user, such as your phone number, username, email address, city, state, or geographic location. You may also designate an authorized agent to make a request to Pro Teeth Guard to disclose or delete your personal information. To do so, you must provide Pro Teeth Guard with proof that the individual or business has been appointed as your agent, such as by providing a signed power of attorney form and provide accurate responses to any information requested by Pro Teeth Guard that may be necessary to confirm that you are a Pro Teeth Guard user, such as your phone number, username, email address, city, state, or geographic location. California residents have a right not to receive discriminatory treatment by Pro Teeth Guard for their exercise of these rights conferred under California law.
Colorado Residents
Pro Teeth Guard does not control or process the personal data of 100,000 or more consumers during a calendar year, or derive revenue or receive a discount on the price of goods or services from the sale of personal data. Therefore, the Colorado Privacy Act does not apply to Pro Teeth Guard's collection and use of PII.
Connecticut Residents
During the preceding calendar year, Pro Teeth Guard did not control or process the personal data of at least 100,000 consumers or derive more than 25% of our gross revenue from the sale of personal data. Therefore, the Connecticut Data Privacy Act does not apply to Pro Teeth Guard's collection and use of PII.
Montana Residents
Pro Teeth Guard does not control or process the personal data of 50,000 or more Montana residents during a calendar year or derive over 25% of its revenues from the sale of personal data and control or processing of personal data of 25,000 or more Montana residents. Therefore, the Montana Consumer Data Privacy Act does not apply to Pro Teeth Guard's collection or use of PII.
Nevada Residents
If you are a resident of Nevada, you may provide notice to us to limit the sale of your PII to third parties for resale or licensing purposes. To notify us that you wish to limit the sale of your PII to third parties for resale or licensing purposes, you may contact us using our contact submission form at https://www.proteethguard.com/contact-pro-teeth-guard/. In your submission please include the statement "Nevada Do Not Sell Request," along with your name, address, and user account information.
Tennessee Residents
Pro Teeth Guard does not exceed $25 million in annual revenue, control or process the personal information of 175,000 or more Tennessee consumers, or control or process the data of 25,000 consumers while deriving more than 50% of its gross revenue from the sale of personal information. Therefore, the Tennessee Information Protection Act does not apply to Pro Teeth Guard's collection and use of PII.
Texas Residents
Pro Teeth Guard is considered a small business as defined by the Small Business Administration and, therefore, is exempt from the Texas Data Privacy and Security Act. However, Pro Teeth Guard generally collects and processes PII only to the extent that it is adequate, relevant, and reasonably necessary for the purposes disclosed in this Privacy Notice. The categories of PII collected by Pro Teeth Guard are disclosed within this Privacy Notice, in particular in the table above, and Texas residents may request, free of charge, information of the PII collected from them twice annually.
Utah Residents
Pro Teeth Guard does not have annual revenues of $25,000,000 or more and control or process the PII of 100,000 or more consumers. Therefore, the Utah Consumer Privacy Act does not apply to Pro Teeth Guard's collection and use of PII.
Virginia Residents
Pro Teeth Guard does not control or process the personal data of at least 100,000 Virginia residents or control or process the personal data of at least 25,000 Virginia residents and derive more than 50% of its gross revenue from the sale of personal data. For these reasons, the Virginia Consumer Data Protection Act (VCDPA) does not apply to Pro Teeth Guard's collection and use of PII.
State Biometric Privacy Laws
Illinois Biometric Information Privacy Act (BIPA): While Pro Teeth Guard does not meet the revenue or consumer thresholds that would subject it to certain state privacy laws, we recognize that Illinois has specific requirements for the collection of biometric information. To the extent BIPA applies to Pro Teeth Guard's collection of dental impressions and biometric data from Illinois residents, Pro Teeth Guard complies with BIPA's requirements as described throughout this Privacy Notice, including obtaining informed consent, providing written notice of collection purposes and retention periods, implementing security measures, and not selling or profiting from biometric data.
Texas Capture or Use of Biometric Identifier (CUBI): For Texas residents, Pro Teeth Guard informs you prior to capturing your biometric identifiers (dental impressions) and obtains your consent as described in this Privacy Notice. Pro Teeth Guard does not sell, lease, or disclose your biometric identifiers except as disclosed in this Privacy Notice, and destroys biometric identifiers within a reasonable timeframe as described in our retention policy.
Washington Biometric Privacy Laws: For Washington residents, Pro Teeth Guard provides notice and obtains consent before enrolling your biometric identifier in a database, and does not sell, lease, or disclose biometric identifiers for commercial purposes except as disclosed in this Privacy Notice.
Other State Laws: Several states, including California, Colorado, Connecticut, Virginia, and others, classify biometric information as "sensitive personal information" under their comprehensive privacy laws. Pro Teeth Guard treats biometric data with heightened protection and provides appropriate notices and rights to residents of these states as described throughout this Privacy Notice.
Global Privacy Control
